Terms of use

The short version

  • What you make with our instruments is yours, including for releases and commercial use.
  • Only melt audio you have the rights to use.
  • When you buy an instrument or a pass, you get a licence to use it for as long as Odd Hours runs it. You don't own the software itself.
  • The Founders Pass covers every numbered instrument (001 onwards, however many there are). Only 250 will ever be sold.
  • Purchases are handled by Paddle, and our Refund policy explains how refunds work.
  • Nothing here takes away your rights under Australian Consumer Law.

About these terms

These terms apply when you use oddhoursaudio.com, our instruments (starting with MELT / 001), our emails and any account or purchase with us. Odd Hours is the trading name of Odd Hours Audio, a registered business name of Zac Cause (ABN 46 187 830 165), a sole trader based in Victoria, Australia ("Odd Hours", "we", "us"). By using the site or an instrument, you agree to these terms. If you don't agree, please don't use them.

Some features below, such as accounts and purchases, aren't live yet. They're marked coming soon and are covered here so these terms are ready when they are.

Using the instruments

Anyone can play our instruments in the browser for free. Some features, such as longer clips and higher-quality exports, need a free account or a purchase. What each option includes is shown on the instrument's page and at checkout.

Please don't:

  • copy, resell, reverse-engineer or redistribute the instruments, their code or their artwork
  • try to get around export limits, payment, or the protections that keep the site running
  • use the instruments to process audio you don't have the right to use
  • use the site in a way that breaks the law or harms other people

What you make is yours

You own the audio you export from our instruments. You can use it in your own music, releases, videos, live sets, sync and anything else, commercially or not, with no royalties and no credit required (though a mention is always appreciated).

That depends on the audio you put in. You're responsible for having the rights to anything you load into an instrument. Melting someone else's recording doesn't make it yours.

The demo tapes and sounds that come with an instrument are ours. You can use them inside your own tracks like any other exports, but you can't repackage or sell them as samples, loops or sound packs.

Your audio stays with you

Our instruments run in your browser. Audio you load and the takes you make stay on your device and aren't uploaded to us. That also means we can't recover them if your browser data is cleared, so download anything you want to keep. See our Privacy policy for more.

Accounts coming soon

An account is for one person. Keep your sign-in details to yourself, and let us know if you think someone else has used your account. You must be at least 13 to create an account, and 18 (or have a parent's or guardian's permission) to make a purchase.

You can delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms. If we close your account without a good reason under these terms, we'll refund what you paid for anything you lose access to.

Buying instruments and passes coming soon

Our online shop is run by Paddle.com, which acts as the merchant of record: Paddle sells to you on our behalf, takes payment, handles tax and issues your receipt. Paddle's buyer terms apply to the purchase itself, and these terms apply to what you're buying.

  • Prices are shown at checkout, in your currency where available, including any tax Paddle collects.
  • An instrument purchase is a one-off payment that unlocks that instrument's paid features on your account, with no subscription.
  • A pass is a one-off payment that unlocks a set of instruments, as described below and at checkout.
  • Upgrading: if you bought a single instrument and later buy a pass, what you paid for the instrument counts towards the pass.

The Founders Pass

The Founders Pass is a one-off payment that covers:

  • Every numbered Odd Hours instrument: MELT / 001 and every instrument we release after it with a series number (/002, /003 and onwards), however many we make. There's no set number, and the pass doesn't run out partway through the series.
  • Every paid feature of those instruments, including features we add to them later.

It doesn't cover things that aren't numbered instruments, such as merchandise, physical products, sound or sample packs, or one-off collaborations sold separately.

Only 250 Founders Passes will ever be sold. The count is kept by our server and checkout closes automatically at 250; after that, instruments are sold individually. A pass is for one person's account and can't be transferred or resold.

What "lifetime" means

When we say you have access for life or forever, we mean for as long as Odd Hours runs the instrument. We plan to be around for a long time. If we ever have to stop running an instrument you've paid for, we'll give you at least 60 days' notice so you can export what you need.

Changes to the instruments

We keep improving our instruments, so features and sounds may change over time. We won't take away the core of something you've paid for. If a change would do that, you can ask for a refund under our Refund policy.

Our work

The Odd Hours name, logos, instruments, code, artwork, sounds and writing belong to Odd Hours or to the artists we've commissioned. These terms don't give you any right to use them, apart from using the instruments as described here. Commissioned artwork is credited on the page where it appears.

Your rights under Australian Consumer Law

Our products come with guarantees that can't be excluded under the Australian Consumer Law. For major failures with a service, you're entitled to cancel and get a refund for the unused part, or compensation for its reduced value. You're also entitled to be compensated for any other reasonably foreseeable loss or damage. Nothing in these terms limits those rights, or similar rights you have where you live.

Limits on our responsibility

Apart from the rights above that can't be excluded, the instruments are provided as they are. We do our best to keep them working, but we can't promise they'll always be available, error-free, or work with every browser and device.

To the extent the law allows, we're not responsible for indirect or unforeseeable losses, and our total responsibility to you is limited to what you've paid us in the 12 months before the problem arose. Protect your hearing and your speakers: our instruments can be loud, so start with the volume low.

Changes to these terms

We may update these terms as Odd Hours grows, for example when accounts and purchases go live. We'll change the date at the top and, for significant changes, tell people on the email list. Changes don't apply to purchases made before them where that would leave you worse off.

The law that applies

These terms are governed by the law of Victoria, Australia. If you're a consumer elsewhere, you keep any protections the law where you live gives you.
